1. Agreement to Terms
Welcome to bartendersNow™ (the "Platform"), operated by Midnight Logic, Inc. ("Company," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and the Company concerning your access to and use of the bartendersNow™ website and any related services.
By accessing the Site, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these terms, you are expressly prohibited from using the Site and must discontinue use immediately.
2. Description of Service
The bartendersNow™ Platform is a proprietary, technology-driven solution designed to serve as a comprehensive tool for event beverage needs.
Beta Site: The current version of this Site is a pre-launch beta site. Its sole purpose is to provide information about our upcoming services and to allow interested parties to sign up for news and updates. No transactions or bookings can be made on the current Site.
Future Platform: The full Platform will connect event hosts with a network of identity-verified bartenders. It will feature tools such as the "Stock List" to generate beverage shopping lists and will integrate with partners to facilitate ancillary services like alcohol fulfillment, equipment rentals, and event insurance.
3. User Eligibility
This Platform is intended for users who are of the legal drinking age in their jurisdiction. By using this Site, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements.
4. Intellectual Property Rights
Unless otherwise indicated, the Platform is our proprietary property. All source code, databases, functionality, software, website designs, text, and graphics on the Site (collectively, the "Content") and the trademarks and logos contained therein (the "Marks") are owned or controlled by us. The Content and the Marks are protected by copyright and trademark laws. "bartendersNow™" and its associated logos are trademarks of Midnight Logic, Inc.
5. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
6. Third-Party Links & Partners
The future Platform will include features that allow you to purchase services from third-party partners, such as alcohol delivery and event insurance providers. We are not responsible for the services or content of these third-party partners. Your interactions with any third party are solely between you and that third party.
7. Disclaimer
The Site is provided on an "as-is" and "as-available" basis. You agree that your use of the Site and our future services will be at your sole risk.
Crucially, bartendersNow™ is a technology platform, not an employer or employment agency. Our service connects hosts with independent bartending professionals. We do not employ the bartenders, and we are not responsible for their conduct, performance, or compliance with local regulations. The platform is a tool to facilitate connections.
8. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Site or our future services.
9. Term and Termination
These Terms of Service shall remain in full force and effect while you use the Site. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site to any person for any reason.
